Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Survey App website (surveyapp.org) and the associated iOS application (together, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts
The Service is intended for authorized users only. Access is provided through accounts issued by us. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account.
You may not share your account, allow others to use it, or use another person’s account without authorization.
2. Acceptable use
You agree to use the Service only for its intended purpose and in compliance with all applicable laws. You agree not to:
- access or attempt to access data, accounts, or systems you are not authorized to use;
- interfere with, disrupt, or compromise the security or integrity of the Service;
- reverse engineer, decompile, scrape, or attempt to extract source code or underlying data except as expressly permitted;
- use the Service to store or transmit unlawful, infringing, or harmful content; or
- use the Service in any way that could damage, disable, or impair it, or interfere with any other party’s use of it.
We may suspend or terminate access for any violation of these Terms.
3. The data you submit
The Service is used to record and organize field-collected retail survey information. You are responsible for the accuracy of information you enter. You represent that you have the right to submit any information you provide through the Service.
4. Ownership of the Service
The Service, including its software, design, and content (excluding data submitted by users), is owned by us or our licensors and is protected by applicable intellectual property laws. Except for the rights expressly granted to you to use the Service, no rights are transferred to you. You may not copy, modify, distribute, or create derivative works of the Service without our prior written permission.
5. Confidentiality
Information made available to you through the Service may be confidential and is provided solely for your authorized use. You agree not to disclose, publish, or use such information for any purpose other than your authorized use of the Service.
6. Availability and changes
We may modify, suspend, or discontinue the Service, in whole or in part, at any time and without notice. We may also update these Terms from time to time; the “Last updated” date above reflects the most recent version. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
7. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any information obtained through the Service is accurate or reliable.
8. Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use the Service, whether based in contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service or your violation of these Terms.
10. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Texas.
